PREAMBLE
The purpose of this Shipping and Delivery Policy (hereinafter "the Policy") is to inform Buyers of the shipping and delivery conditions of Products ordered on the ApexFPV website. It is drawn up in accordance with Articles L.216-1 et seq. of the Consumer Code, Directive 2011/83/EU on consumer rights, and constitutes a contractual document integrating the General Terms and Conditions of Use and Sale of ApexFPV.
By placing an order on the Site, the Buyer acknowledges that he or she has read and unreservedly accepted the provisions of this Policy.
ARTICLE 1 — DELIVERY AREAS
1.1 Destinations served
ApexFPV ships its Products to the following destinations, under the conditions and limits specified below:
· Metropolitan France (including Corsica);
· Overseas Departments and Regions (DROM): Guadeloupe, Martinique, French Guiana, Reunion Island, Mayotte;
· Countries of the European Union.
1.2 Applicable Restrictions
Some Products may be subject to delivery restrictions due to their nature (e.g., classified drones, lithium-ion batteries subject to air transport regulations, etc.) or customs and export regulations specific to certain destination countries. Where applicable, ApexFPV shall inform the Purchaser during the order process or as soon as possible after it has been placed. If delivery to the chosen destination is not possible, the order will be cancelled and fully refunded.
1.3 Delivery outside the European Union
For deliveries to countries outside the European Union (if applicable), the Buyer is solely responsible for compliance with the customs, import and tax regulations applicable in his country of residence. Customs duties, import taxes and administrative fees that may be payable at the border are the sole responsibility of the Buyer and are not included in the Price displayed on the Site.
ARTICLE 2 — DELIVERY COSTS
2.1 Calculation of Fees
Shipping costs are calculated based on the total weight of the order, the delivery destination and the shipping method selected by the Buyer. The exact amount of the delivery costs is displayed in a clear and legible manner during the order summary, before any final validation, in accordance with Article L.221-14 of the Consumer Code.
2.2 Indicative price list
As a guideline, the applicable delivery charges are as follows. These rates are subject to change without notice; Only the amount displayed at the time of validation of the order is contractual:

The exact delivery costs are displayed in real time during the checkout process, depending on the selected delivery method and the destination address entered.
2.3 Free Shipping
ApexFPV may offer free shipping offers from time to time above a minimum order amount. The conditions of these offers (applicable threshold, eligible destinations, period of validity) are specified on the Site at the time of the offer and take precedence over these provisions during their period of validity.
ARTICLE 3 – PROCESSING AND PREPARATION OF ORDERS
3.1 Completion time
ApexFPV undertakes to process and prepare orders within one (1) to two (2) business days from receipt of payment and order confirmation. This processing time is understood to be excluding the transport time by the carrier.
3.2 Working days
Working days are Monday to Friday, excluding French public holidays. Orders placed after 14:00 on a working day, or placed on a weekend or public holiday, will be processed from the next working day.
3.3 Stock availability
ApexFPV strives to keep the availability information on the Site up to date. In the event that a Product is unavailable after the order has been validated, ApexFPV shall inform the Buyer as soon as possible and shall offer him/her, in accordance with Article L.216-6 of the Consumer Code:
· a substitute Product of equivalent or better quality and price, subject to the agreement of the Buyer;
· the full refund of the sums paid within fourteen (14) days.
ARTICLE 4 — METHODS OF SHIPPING
4.1 Partner Carriers
ApexFPV uses approved professional carriers for the delivery of the Products. The carriers used include:
· La Poste / Colissimo (home delivery or relay point);
· Mondial Relay (delivery to relay points);
· Chronopost (express delivery);
· DPD, UPS or any other partner carrier depending on availability and destination.
ApexFPV reserves the right to change partner carriers at any time, subject to maintaining an equivalent quality of service.
4.2 Packaging
ApexFPV takes the utmost care in the packaging of the Products to ensure their protection during transport. Fragile or bulky Products are subject to reinforced packaging adapted to their nature. ApexFPV is committed to packaging lithium-ion batteries in accordance with IATA and IMDG regulations applicable to the transportation of dangerous goods.
4.3 Tracking Number
As soon as the order is shipped, ApexFPV will send the Buyer a shipping confirmation email containing, when the carrier allows it, a tracking number allowing the location of the package in real time on the carrier's website. The Buyer is invited to follow the delivery of his package and to be available to receive it.
ARTICLE 5 – DELIVERY TIMES
5.1 Indicative deadlines
Delivery times are given as an indication and run from the date of shipment. They correspond to the delivery times communicated by the partner carriers and are not guaranteed. Delays may occur due to circumstances beyond ApexFPV's control (carrier overload, weather conditions, customs formalities, force majeure, etc.).
5.2 Legal maximum time limit
In accordance with Article L.216-6 of the French Consumer Code, if ApexFPV has not completed the delivery on the date or at the end of the agreed period, and if this delay exceeds seven (7) working days beyond the maximum period indicated on the Site, the Consumer may terminate the contract by notifying ApexFPV by any means allowing receipt to be acknowledged. In such a case, ApexFPV will refund the sums paid in full within fourteen (14) days, unless the Product has been shipped in the meantime.
5.3 Force majeure
ApexFPV cannot be held responsible for delays in delivery resulting from circumstances constituting a case of force majeure within the meaning of Article 1218 of the Civil Code, in particular: natural disasters, general strikes by carriers, epidemics, pandemics, armed conflicts, restrictive government decisions or failures of the national postal network. In this case, ApexFPV undertakes to inform the Buyer as soon as possible and to propose alternative solutions.
ARTICLE 6 — TRANSFER OF RISK AND OWNERSHIP
6.1 Risk Transfer
In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage to the Products is transferred to the Consumer at the time the latter, or a third party designated by the Consumer (other than the carrier), takes physical possession of the Products. For deliveries to a carrier chosen by the Consumer without this option having been offered by ApexFPV, the risk is transferred as soon as the carrier is handed over.
6.2 Transfer of Ownership
Ownership of the Products is transferred to the Buyer upon full payment of the Price, in accordance with the rules of French common law. ApexFPV expressly reserves ownership of the Products until full and final payment of the order.
ARTICLE 7 – RECEIPT AND VERIFICATION
7.1 Obligation to verify upon receipt
Upon receipt of the order, the Buyer is invited to immediately check:
· the external condition of the package (shocks, tears, wetting, signs of opening);
· the conformity of the Products received in relation to the order placed (references, quantities, condition);
· the integrity of the Products (absence of visible damage).
7.2 Reservations and remedies in the event of damage
In the event of apparent damage, damaged or missing parcels found on delivery, the Buyer must:
· express precise, detailed and reasoned reservations on the delivery note in the presence of the delivery person (or refuse the package if the damage is obvious);
· notify ApexFPV within three (3) working days of the delivery date, via the contact form on the Site, attaching photographs of the damaged package and Products;
· send a letter of complaint by registered mail with acknowledgement of receipt to the carrier within the same period, in accordance with Article L.133-3 of the French Commercial Code.
In the absence of reservations made within this period, the Buyer is deemed to have accepted the Products as is and cannot claim any subsequent apparent damage against ApexFPV in respect of delivery. This provision does not prevent the exercise of the legal guarantees of conformity and against latent defects.
7.3 Missing or Non-Conforming Product
In the event of a Product missing or not conforming to the order, the Buyer must contact ApexFPV via the contact form on the Site within fourteen (14) days of receipt. ApexFPV proceeds, as the case may be and after verification, to send the missing Product, to replace the non-compliant Product or to reimburse the sums unduly received.
ARTICLE 8 — FAILED DELIVERY, ABSENCE AND UNCLAIMED PACKAGE
8.1 Unsuccessful Delivery Attempt
In the event of absence during the home delivery attempt, the carrier leaves a notice allowing the Buyer to reschedule the delivery or to collect his package from a post office or relay point within the period indicated by the carrier (generally fifteen (15) calendar days).
8.2 Package Returned to Sender
If the package is returned to ApexFPV due to an incorrect delivery address provided by the Buyer, a prolonged absence without collection of the package, or an unjustified refusal of delivery, ApexFPV will contact the Buyer to agree on the terms of reshipment. The costs of reshipment are the sole responsibility of the Buyer. If the Buyer does not wish to be reshipped, ApexFPV will refund the Products less the original delivery costs and the return costs incurred.
8.3 Incorrect Shipping Address
The Buyer is solely responsible for the accuracy of the delivery information provided at the time of the order. ApexFPV accepts no responsibility for any delay, loss or non-delivery resulting from an incomplete, incorrect or out-of-date address. In the event of an error detected by the Buyer after validation of the order, the latter must contact ApexFPV as soon as possible via the contact form on the Site, it being understood that no modification can be guaranteed if the order is already being shipped.
SECTION 9 — LOSS, THEFT AND PACKAGE REPORTED DELIVERED BUT NOT RECEIVED
9.1 Package considered lost
A package is considered lost when the carrier is unable to justify its delivery within the normal delivery time plus ten (10) working days. In the event of a proven loss, the Buyer must inform ApexFPV via the contact form on the Site. ApexFPV then opens an investigation with the carrier and, depending on the result:
· re-dispatches the Products at its own expense, if available in stock;
· reimburses the Buyer in full for the sums paid within fourteen (14) days.
9.2 Package reported delivered but not received
If the carrier's tracking indicates a delivery made but the Buyer declares that he has not received his package, the latter must contact ApexFPV within forty-eight (48) hours of the delivery date indicated by the carrier. An investigation has been opened with the carrier. ApexFPV cannot be held responsible in the event of theft after delivery confirmed by the carrier to the address provided by the Buyer.
ARTICLE 10 – RIGHT OF WITHDRAWAL AND RETURNS
10.1 Reminder of the right of withdrawal
In accordance with Articles L.221-18 et seq. of the Consumer Code, the Consumer has a period of fourteen (14) calendar days from the date of taking physical possession of the Products to exercise their right of withdrawal, without having to justify reasons or bear any penalties, with the exception of the return costs. The full terms and conditions for exercising the right of withdrawal are defined in the ApexFPV General Terms and Conditions of Use and Sale.
10.2 Return Procedure
To exercise their right of withdrawal or return a defective Product, the Buyer must:
· notify ApexFPV of its decision via the contact form on the Site or by mail to: ApexFPV — 4B rue Alfred Nobel, 77420 Champs-sur-Marne;
· Wait for ApexFPV confirmation and return instructions.
· return the Products in their original condition, complete and in their original packaging if possible, to the address provided by ApexFPV.
The return costs are borne by the Buyer for ordinary withdrawals. In the event of a defective or non-compliant Product, ApexFPV will cover the return shipping costs.
10.3 Refund
ApexFPV will provide a full refund to the Buyer within fourteen (14) days of receipt of the returned Products or production of proof of shipment, by the same means of payment used for the order, at no additional cost.
ARTICLE 11 — TRANSPORT OF SPECIFIC PRODUCTS
11.1 Lithium-ion Batteries
The transport of lithium-ion batteries (LiPo, Li-ion) is subject to strict regulations (ADR Regulations, IATA regulations for air transport, IMDG for maritime transport). ApexFPV packages and ships batteries in accordance with applicable regulatory requirements. Restrictions may apply to shipping batteries to certain destinations or depending on the mode of transportation used. In the event that it is not possible to ship a battery to the chosen destination, ApexFPV will inform the Buyer and offer the available alternatives.
11.2 Drones and Remotely Operated Aircraft
The export of certain drones and FPV equipment may be subject to specific controls and authorizations according to French and European foreign trade regulations (Regulation (EU) 2021/821 on the control of exports of dual-use items). ApexFPV reserves the right to refuse or defer any order for which the required export controls cannot be met.
ARTICLE 12 – INVOICING AND TAX OBLIGATIONS
12.1 Invoice
ApexFPV issues an invoice for each order and sends it to the Buyer electronically at the address provided at the time of the order. The invoice summarises the details of the Products, the unit prices including VAT, the delivery costs and the total including VAT.
12.2 VAT and applicable tax
The prices displayed on the Site are expressed in euros including VAT, including French VAT at the rate in force. For deliveries to another Member State of the European Union, the applicable VAT is that of the Consumer's country of destination, in accordance with the OSS (One Stop Shop – Regulation (EU) 2017/2455) rules applicable to online sales.
ARTICLE 13 — MODIFICATION OF THE SHIPPING POLICY
ApexFPV reserves the right to modify this Policy at any time, in particular to take into account changes in partner carrier offers, postal rates or applicable regulations. The changes take effect when they are posted on the Site. The Policy applicable to an order is the one in force at the time of validation of the said order.

ApexFPV will respond to any delivery claims within two (2) business days. In the event of an unresolved dispute, the Buyer may resort to consumer mediation in accordance with the provisions of the General Terms and Conditions of Use and Sale.
