RETURNS AND REFUNDS POLICY

ApexFPV — FPV & Drone Equipment Online Store

1. Scope

This policy applies to any purchase made on http://www.apexfpv.fr by a consumer within the meaning of the introductory article of the Consumer Code, acting for purposes that are not part of a professional activity.

2. Return and refund period

In accordance with Directive 2011/83/EU of 25 October 2011, transposed into Articles L.221-18 to L.221-28 of the Consumer Code, all consumers have a legal right of withdrawal of 14 calendar days from receipt of the goods, without having to justify reasons or pay penalties.

On a commercial basis, ApexFPV grants an extended period of 30 calendar days from the date of receipt of the package.

Deadline freeze mechanism: the 30-day count is frozen as soon as our customer service receives your contact request. This protects you from overruns due to processing times on our end. It is your responsibility to keep proof of the sending of your request (email, screenshot, form reference). An automatic acknowledgement of receipt will be sent to you in order to establish the date of the freeze enforceably.

3. Mandatory procedure – Request for prior contact

No unauthorized returns will be accepted or refunded. Before physically returning the product, you must contact our customer service via the Contact section of our http://www.apexfpv.fr website.

Once your application is received:

  1. We will respond within 1 week with a return number (RMA) and shipping instructions, including the return address.
  2. You ship the product in the right packaging, with the RMA number on the package.
  3. Upon receipt, we will check the product within 1 week.
  4. The refund or exchange is processed within 14 calendar days of receipt of the return, in accordance with Article L.221-24 of the Consumer Code.

 

The return address is communicated to you exclusively during this mandatory contact.

4. Return shipping costs

Return shipping costs are fully covered by ApexFPV, without exception. No costs will be charged to you for the return of the product.

5. Conditions for accepting the return

To be accepted, the returned product must:

       be in its original condition, unused, unaltered and undamaged by the customer;

       be accompanied by all its accessories, instructions and original elements;

       be packaged in such a way as to guarantee its integrity during transport;

       be accompanied by the RMA number provided by our customer service.

 

Any product returned outside of these conditions may be subject to a discount or a refusal of refund, in accordance with Article L.221-23 of the Consumer Code.

6. Products and situations excluded from the right of withdrawal

In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to:

       products made to the consumer's specifications or clearly personalised;

       products that are likely to deteriorate or expire quickly;

       products that are unsealed after delivery and cannot be returned for reasons of hygiene or health protection;

       audio or video recordings or computer software unsealed after delivery;

       products whose price depends on fluctuations in the financial market beyond the control of the seller.

7. Refund Terms

The refund will be made no later than 14 calendar days after receipt of the returned product, using the same means of payment as that used for the original purchase, unless you expressly agree otherwise.

The initial delivery costs are reimbursed in the event of withdrawal of the entire order.

8. Defective, damaged or incorrect order products

If the product received is defective, damaged in transit, or different from the one ordered, we are responsible and the processing of your file is a priority. Return shipping costs are of course covered. You can choose to have an identical exchange or a full refund, including the initial delivery fee. Proof of the defect found (photo of the product and/or package) will be requested when contacting us via the Contact section of our http://www.apexfpv.fr website.

9. Legal Warranties

Legal guarantee of conformity (art. L.217-3 et seq. of the Consumer Code): 2 years from the delivery of the good. In the event of a defect, you are entitled to have the product repaired or replaced. If this is impossible or disproportionate, you will be granted a price reduction or full refund. During the first 24 months, you do not have to prove the anteriority of the defect (legal presumption — Art. L.217-7 C.conso).

Legal warranty against latent defects (art. 1641 et seq. of the Civil Code): 2 years from the discovery of the defect. You can choose between the full restitution of the price (redhibitory action) or a reduction in the price with conservation of the property (estimatory action) — art. 1644 of the Civil Code.

10. Processing of personal data in the context of returns

The data collected during a return request (name, address, email, order number, reason) is processed on the basis of the performance of the contract (art. 6.1.b GDPR) and kept for 3 years from the closure of the file. 11. Mediation and Remedies

In the event of a dispute that is not resolved amicably, you can refer the matter to the designated consumer mediation entity free of charge: FEVAD, http://www.shopify.com. You can also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

This contract is subject to French law. For consumers, the competent court is the court of the consumer's domicile in accordance with European law.
